Alle-Kiski Today and Three Rivers Broadband, Inc. Publisher, offer publishing your article, news and photos as a free service to our community and its organizations. To publish your articles you must read and agree to the TERMS OF SERVICE that outline the guidelines and under what terms you may freely publish local articles. These TERMS OF SERVICE are a legal document and by submitting your articles you agree to the following: Three Rivers Broadband, Inc. Publisher of Alle-Kiski Today offers this free board to post community articles, news and photos according to the "Terms of Service" listed here. We reserve the right to reject, edit or alter any article submitted and by accepting use of this free service, and by submitting an entry, you hereby indemnify and hold harmless Three Rivers Broadband, Inc. , it's owners, principals, officers, employees, and associates from any claims, damage, costs, fees or expenses as a result of your submitting and/or posting news, your violating any local, state or federal laws or regulations, and editing, altering or rejection of your articles, and that in consideration of this Agreement, Three Rivers Broadband, Inc. may provide you with free publishing of community news.

1. Three Rivers Broadband, Inc. offers the Alle-Kiski Today web site (the "Web Site"), to you, the user, conditioned upon your acceptance of all of the terms, conditions, policies and notices stated on the Web Site. By using the Web Site, you signify your assent to these Terms and Conditions and any subsequent modifications. Alle-Kiski Today may revise these Terms and Conditions from time to time by updating this posting, with the new terms taking effect on the date of posting. You should review these Terms and Conditions every time you use this Web Site as they are binding upon you.
2. The Alle-Kiski Today site is for your personal use. As a condition to your continued use of the Web Site, you warrant to Alle-Kiski Today that you will not use the Web Site for any purpose that is unlawful or prohibited by these Terms and Conditions.
3. You may publish articles online by accessing our web site at http://www.alle-kiskitoday.com/submit and entering the information online and then submitting it for approval.
4. All submitted articles will be reviewed for content and acceptability before being published. We may reject, edit or alter any article submitted.
5. We do not guarantee publication of your articles.
6. Alle-Kiski Today does not endorse and is not responsible for any statement, opinion, and advice given or made in these postings. Your use of the Alle-Kiski Today is at your own risk
7. Alle-Kiski Today reserves the right to limit or terminate service to participants who violate the terms of this Agreement.
8. If your article is approved it will normally appear within 72 business hours, but we do not guarantee any time limit for publishing.
9. Your article may be news, announcement, events, in one of these categories: General Local News; Announcements; Business; Health & Fitness; Home & Garden; Fashion; Community Service; Culture; Dining; Finance; Sports; Events; Religion; Obituaries; Weddings; Births; Anniversaries; Entertainment; Fire Blotter; Human Interest; Politics; Education; and, Opinion.
10. We accept articles, news stories and pictures about your organization, church, civic group, government entity, public safety, school, hospitals, businesses (see #23) and other community groups for publication. You may also post stories about weddings, births, anniversaries, human-interest (such as news on soldiers), deaths (obituaries) or categories that would normally be acceptable to media publications. You write your story and submit it and any photos you may have.
11. Please write your story with proper grammar and spelling.
12. Do not use ALL CAPS. Capitalize only proper names and places.
13. Do not use formatting other than standard paragraphs with three spaces in between each paragraph. Do not double-space lines within paragraphs.
14. Write a headline to your news submission.
15. Follow instructions at www.alle-kiskitoday.com/submit/
16. We encourage you to submit photos to go with your story submission. All photos should be properly identified and persons appearing in the photo, if there are more than one, identified by name from left to right.
17. If a story does not appear do not resubmit the story.
18. Submit Your Story is a free community service and as such we do not offer any support or service.
19. You agree not knowingly to submit any false, defamatory, abusive, obscene, threatening, racially offensive, sexually explicit or illegal material to the Web site.
20. You may not submit information that is libelous or defamatory or that discloses private or personal matters concerning any person.
21. You may not post information or links that are obscene or pornographic
22. You may not contribute information or pictures that violate the property rights of others, including unauthorized copyrighted, test, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion.
23. Businesses may publish news or stories that represent community interest, such as participation and/or support of community events and organizations that serve the greater community, announcements of new employees joining the company, and, stories about employees that are serving the community. Businesses may not publish any material that serves as advertising or promotion of products and services that qualify for advertising. Businesses that are contractual advertisers of Alle-Kiski Today multi-media services may receive exceptions and consideration of submitted news items that are written and qualify as community interest.
24. These Terms of Service are not all inclusive of every possible scenario and because of this Alle-Kiski Today and Three Rivers Broadband, Inc. reserve the right to accept or reject a submission for any reaon.
25. "News" is defined to mean a legitimate article of community interest regarding, Business, an event, plans, or happenings as related to churches, community organizations, charities, non-profit groups, civic clubs, educational institutions, health institutions, public safety entities, local and regional government entities, and any other entity that serves the community at large or individual or family news that would be of general and public interest.
26. “Announcements” and “Events”, in order to be published as a news story, must be written as a news story with information and details as opposed to a listing of facts.
27. "Public interest" is defined to mean what media considers to be news that the general public accepts and believes to be news of interest.
28. Your must be directly related by position, membership or relationship of the entity that you are representing and reporting about and your news article may not be about third parties that you do not represent.
29. News articles that contain negative content in any form or by inference will not be accepted. We reserve the full right to judge and decide if these criteria are met in submitted stories.
30. If you publish names and use photos of persons you must have the consent and permission of those persons mentioned.
31. You assert that the information and pictures you contribute are your own or you are the designated representative of an entity to do so, are licensed to be uploaded and downloaded by other participants, are in the public domain, or are otherwise free of copyright or other restrictions. You also grant Alle-Kiski Today an irrevocable, nonexclusive, royalty-free license to redistribute or republish the information in any medium or form.
32. In no event will Alle-Kiski Today be liable for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of business profits, business interruption, loss of programs or information, and the like) arising out of the Alle-Kiski Today posted articles, or any information or services provided on Alle-Kiski Today, even if Alle-Kiski Today has been advised of the possibility of such damages, or for any claim attributable to errors, omissions, or other inaccuracies published on Alle-Kiski Today.
33. Alle-Kiski Today is not responsible for censoring or monitoring postings but it reserves the right to enforce the policies outlined in this document, and reserves the right to move or remove articles at its sole discretion and without explanation
34. Three Rivers Broadband, Inc. and Alle-Kiski Today retain full copyright ownership, rights and protection in all material contained on Alle-Kiski Today, including but not limited to material submitted by community contributors.
35. Except as otherwise expressly provided in these Terms and Conditions, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, rewrite, create derivative works from, transfer, or sell any material contained on the Web Site without the prior consent of the copyright owner. You agree not to modify any documents, graphics, images or other material found on this Web Site.
36. You may, however make single copies of materials displayed on the Alle-Kiski Today Web Site for your own personal and noncommercial use only, provided any copies include the copyright and other notices displayed with the materials on the Web Site. You may not distribute such copies to others, whether or not for a charge or other consideration, without prior written permission from Alle-Kiski Today or the copyright owner of the copied material.
37. None of the material contained on the Alle-Kiski Today site may be reverse-engineered, disassembled, decompiled, transcribed, stored in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold or redistributed without the prior written consent of Alle-Kiski Today. 38. Neither Alle-Kiski Today nor its employees, agents, third party information providers, merchants, licensors or the like warrant that the Web Site or its operation will be accurate, reliable, uninterrupted or error-free. If your use of Alle-Kiski Today results in the need for servicing or replacing property, material, equipment or data, Alle-Kiski Today is not responsible for those costs. No agent or representative has the authority to create any warranty regarding the Web Site on behalf of Alle-Kiski Today. Alle-Kiski Today reserves the right to change or discontinue at any time any aspect or feature of the Web Site.
39. Alle-Kiski Today does not assume any liability for the contents of any material provided on the Web Site. Reliance on any information presented on the Web Site, other than that which you provided, is at your own risk. Alle-Kiski Today reserves the right to change or discontinue any aspect or feature of the Web Site at any time.

Accordingly, Alle-Kiski Today assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Web Site.
41. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON ALLE-KISKI TODAY IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. ALLE-KISKI TODAY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE WEB SITE CONTENT, SOFTWARE TEXT, GRAPHICS, AND LINKS, OR ABOUT RESULTS TO BE OBTAINED FROM USING THE WEB SITE OR ALLE-KISKI TODAY SERVICES.
42. IN NO EVENT SHALL ALLE-KISKI TODAY OR ANY THIRD PARTIES MENTIONED AT THE WEB SITE BE LIABLE FOR ANY COSTS, DAMAGES AND EXPENSES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, HEALTH PROBLEMS, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE ALLE-KISKI TODAY WEB SITE OR THE CONTENT OF THE WEB SITE WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ALLE-KISKI TODAY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALLE-KISKI TODAY SHALL BE LIABLE TO YOU ONLY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT AND ONLY TO THE EXTENT OF ACTUAL DAMAGES INCURRED BY YOU, NOT TO EXCEED U.S. $100.00 (ONE HUNDRED DOLLARS). BECAUSE SOME STATES AND COUNTRIES DO NOT ALLOW THE EXCLUSION OF LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. REMEDIES UNDER THIS AGREEMENT ARE EXCLUSIVE AND ARE LIMITED TO THOSE EXPRESSLY PROVIDED FOR IN THIS AGREEMENT.
43. You agree to defend, indemnify and hold Alle-Kiski Today, its officers, directors, employees and agents, content contributors, licensors and suppliers harmless from and against any claims, actions or demands, liabilities and settlements, including, without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Alle-Kiski Today Web Site in a manner that violates or is alleged to violate these Terms and Conditions. Alle-Kiski Today shall provide you with prompt notice of any such claim, suit or proceeding and shall reasonably cooperate with you, at your expense, in your defense of any such claim, suit or proceeding.
44. The Alle-Kiski Today Web Site may link to other sites operated by third parties. The inclusion of any link to such sites does not imply endorsement by Alle-Kiski Today of the sites, but is for your reference and convenience only. Alle-Kiski Today has not reviewed all of the sites linked to the Web Site and is not responsible for the content or accuracy of any off-site pages or any other sites linked to Alle-Kiski Today. Nor does Alle-Kiski Today recommend or endorse any specific tests, products or procedures that may be mentioned on or represented in advertisements on the Web Site. Visiting off-site pages or other sites is at your own risk and subject to the Terms and Conditions of Use of any hyper-linked site.
45. The Alle-Kiski Today Web Site also contains advertisements by third parties. Unless otherwise specifically stated on the Web Site, Alle-Kiski Today does not endorse or make any representation regarding the liability, quality, or accuracy of any products or services featured in, or linked to any advertisement that appears on the Web Site.
46. Unless otherwise prohibited under these Terms and Conditions, you are hereby licensed to create hyperlinks to the content on the Alle-Kiski Today Web Site, provided that the hyperlink accurately describes the content as it appears on the Web Site. Alle-Kiski Today reserves the right to revoke this license generally, or your right to use specific links, at any time. Under no circumstances may you "frame" the Web Site or any of its content or copy portions of the Alle-Kiski Today Web Site to a server, except as part of an Internet service provider's incidental caching of pages. Each page within Alle-Kiski Today must be displayed in full (including all trademarks, branding, advertising and promotional materials), without any accompanying frame, border, margin, design, branding, trademark, and advertising or promotional materials not originally displayed on the page within Alle-Kiski Today.

You agree that Alle-Kiski Today may terminate your use of the Web Site, if Alle-Kiski Today reasonably believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions of Use, or violated the rights of Alle-Kiski Today or any third party, or for any reason with or without notice to you. You agree that Alle-Kiski Today may modify or discontinue Alle-Kiski Today, with or without notice to you. You agree that Alle-Kiski Today will not be liable to you or any third party as a result of such modification or discontinuation.
48. You expressly agree that exclusive jurisdiction for any dispute with Alle-Kiski Today, or in any way relating to your use of Alle-Kiski Today ("Legal Action"), reside in the courts of the County of Westmoreland, Commonwealth of Pennsylvania. You further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Commonwealth of Pennsylvania in connection with any such dispute. Any Legal Action that is subject to the jurisdiction of federal courts shall be instituted in a federal court in the Western District of Pennsylvania in Pittsburgh, Pennsylvania. These Terms and Conditions are governed by the internal substantive laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. If any provision of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any cause of action you may have with respect to Alle-Kiski Today must be commenced within one year after the claim or cause of action arises or such claim or cause of action is barred.
